Our Services may include cloud-managed networking, Secure SD-WAN, SASE and Zero Trust services, endpoint security, wireless and switching, access control, network monitoring, Digital Twin functionality, Network-as-a-Service, security monitoring, AI-enabled services, managed IT services, and related products and solutions.

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

The information we collect depends on how you interact with Hermes Network and the Services you use.

1.2 Network, Device, and Security Information

Because Hermes provides networking and cybersecurity services, our Services may process technical information relating to networks, users, devices, applications, and connections.

Depending on the Services configured by a Customer, this information may include:

  • IP addresses;

  • MAC addresses;

  • Device identifiers;

  • Hostnames;

  • Device type and operating system;

  • Network addresses and routing information;

  • Authentication and authorization information;

  • User and administrator identifiers;

  • Network traffic metadata;

  • Destination domains or addresses;

  • Bandwidth and usage information;

  • Application and protocol information;

  • Security events;

  • Firewall, IDS/IPS, and threat-detection events;

  • DNS and web-security information;

  • Access-control events;

  • Configuration and policy information;

  • VPN and connection information;

  • Network topology and site information;

  • Device posture information;

  • Logs of administrative and configuration activities; and

  • Other telemetry necessary to operate, secure, and manage the Services.

2. Customer Data

Hermes Network provides services primarily to businesses, organizations, managed service providers, partners, and other institutional customers.

When a Customer uses Hermes Services to process information concerning its employees, customers, contractors, users, devices, or other individuals, Hermes may process that information on the Customer’s behalf.

In these circumstances, the Customer generally determines:

  • What information is collected;

  • Which individuals are covered;

  • The purposes for processing;

  • Which Services are enabled; and

  • How long the information should be retained.

Hermes processes Customer Data primarily to provide, secure, maintain, monitor, and support the Services and in accordance with applicable contractual requirements.

If you interact with an organization using Hermes Network Services, that organization may be responsible for determining how your information is processed. Privacy questions concerning that organization’s use of the Services should generally be directed to that organization.

3. How We Use Information

We may use personal information and technical information to:

  1. Provide and operate the Services;

  2. Provision, authenticate, configure, and manage devices and accounts;

  3. Establish and enforce network and security policies;

  4. Monitor network and system performance;

  5. Detect, prevent, investigate, and respond to security threats;

  14. Provide Digital Twin and network-modeling functionality;

  15. Meter and administer Network-as-a-Service offerings;

  17. Communicate with customers, partners, and prospective customers;

  18. Process transactions and payments;

  19. Detect fraud, abuse, and unauthorized use;

  20. Comply with legal and regulatory requirements;

  21. Protect the security, rights, property, and safety of Hermes Network and others; and

  22. Perform other purposes disclosed at the time information is collected or otherwise permitted by law.

4. Network Monitoring and Security Processing

Some Hermes Services are specifically designed to monitor and protect network traffic, devices, applications, users, and systems.

Depending on the products and configurations selected by a Customer, Hermes may process security and network information such as:

  • Traffic metadata;

  • DNS requests;

  • Application information;

  • Security events;

  • Firewall events;

  • Intrusion detection and prevention events;

  • Malware indicators;

  • Threat intelligence matches;

  • Device posture information;

  • Authentication events;

  • Access requests;

  • Data-loss-prevention events;

  • Security policy violations; and

  • Other information required to identify and respond to threats.

The exact information processed depends on the Customer’s configuration, applicable product, deployment architecture, and applicable agreements.

5. AI and Automated Technologies

Certain Hermes Services may incorporate artificial intelligence, machine learning, analytics, automation, or other automated technologies.

These technologies may be used for purposes such as:

  • Threat detection;

  • Security analysis;

  • Anomaly detection;

  • Network optimization;

  • Application identification;

  • Data-loss prevention;

  • Automated policy enforcement;

  • Security event analysis;

  • Operational monitoring;

  • Network modeling and simulation; and

  • Other functionality described in the applicable Service documentation.

Hermes will process information used by these technologies in accordance with applicable contracts, product configurations, and applicable law.

Customer Data will not be used to train generalized artificial-intelligence models for unrelated third parties unless expressly authorized by the applicable Customer or otherwise permitted by an applicable agreement.

6. Video and Physical-Security Information

Certain Hermes products and solutions may support AI-enabled video surveillance or physical-security functionality.

Where such functionality is enabled by a Customer, the Services may process information from cameras or other physical-security systems, including:

  • Video streams;

  • Video metadata;

  • Security events;

  • Motion or activity events;

  • Object or activity classifications;

  • Camera identifiers;

  • Time and location information; and

  • Other information configured by the Customer.

Customers are responsible for ensuring that their use of video surveillance and related technologies complies with applicable privacy, employment, biometric, recording, notice, and consent requirements.

7. Cookies and Similar Technologies

Our websites and online Services may use cookies, pixels, local storage, SDKs, analytics technologies, and similar technologies.

We may use these technologies to:

  • Operate and secure our websites;

  • Remember preferences;

  • Authenticate users;

  • Analyze website traffic;

  • Understand how visitors use our Services;

  • Measure marketing effectiveness;

  • Improve website performance; and

  • Detect security or technical issues.

Third-party services are governed by their own terms and privacy policies.

8.3 Partners and Managed Service Providers

Hermes may work with authorized MSPs, MSSPs, resellers, telecommunications providers, technology partners, and other business partners to provide Services.

Where applicable, these parties may process information necessary to deploy, administer, support, or manage Services.

8.4 Legal and Regulatory Requirements

We may disclose information where reasonably necessary to:

  • Comply with applicable laws or regulations;

  • Respond to subpoenas, court orders, or other lawful processes;

  • Respond to lawful governmental requests;

  • Enforce agreements;

  • Protect the security or integrity of our systems;

  • Investigate fraud or abuse; or

  • Protect the rights, property, or safety of Hermes Network, our customers, users, or others.

Hermes Network does not sell personal information for monetary consideration.

  • Vulnerability management;

No security system can guarantee absolute security. Accordingly, we cannot guarantee that information will never be accessed, disclosed, altered, or destroyed in violation of our safeguards.

11. Data Retention

We retain personal information, network information, security logs, and other information for as long as reasonably necessary for the purposes described in this Privacy Policy, applicable contracts, and legal requirements.

Retention periods may vary depending on:

  • The applicable Service;

  • Customer configuration;

  • Security requirements;

  • Legal and regulatory obligations;

  • Contractual requirements; and

  • Operational and business needs.

Standard log data may be retained for a minimum of 12 months, unless a different period is specified by contract, applicable law, or the configuration of the applicable Service.

When information is no longer required, we may delete, anonymize, or securely isolate it, subject to backup, security, legal, and contractual requirements.

12. International Data Transfers

Hermes Network and its service providers may process information in countries other than the country where you reside.

Where personal information is transferred internationally, Hermes will implement appropriate safeguards where required by applicable privacy law.

Depending on the applicable jurisdiction, these safeguards may include contractual protections, adequacy mechanisms, or other legally recognized transfer mechanisms.

  • The right to correct inaccurate personal information;

  • The right to request deletion;

  • The right to opt out of certain sales or sharing;

  • The right not to receive discriminatory treatment for exercising applicable privacy rights.

Hermes Network does not sell personal information for monetary consideration.

Our Services are intended for businesses, organizations, and professional users and are not directed toward children.

We do not knowingly collect personal information directly from children under 13.

We may contact customers, prospects, partners, and other business contacts about Hermes products, services, events, webinars, demonstrations, or other business-related matters.

You may unsubscribe from promotional communications by using the unsubscribe mechanism contained in the relevant communication.

We may continue to send non-promotional communications necessary to provide Services, administer accounts, address security matters, or communicate important operational information.

We may update this Privacy Policy periodically to reflect changes to our Services, technology, business practices, or legal requirements.

When we update the Policy, we will revise the “Last Updated” date at the top.
